The Role of Judiciary in Good Governance

Good governance broadly means ruling justly, enforcing laws fairly, respecting human rights, and fighting corruption. The key attributes of good governance can be defined as: Transparency; Responsibility; Accountability; Participation and Responsiveness. These attributes can only be maintained by upholding the rule of law; every act of executive authority has to be judged on the touch stone of constitutionality, legality and propriety

It is a tool of judicial review through which the judiciary checks abuses of power committed by state functionaries. The assurances of fundamental human rights are the basic ingredients of good governance and the judiciary is the ultimate protector of such assurances. The World Justice Project has developed the Rule of Law Index to gauge the level of country's adherence to the Rule in various sectors of national life.

The International Judicial Conference 2012 will provide a forum to review the existing role of judiciary in good governance and suggest reforms to enhance this role.
